Atlases kārtība un termiņi
Komandas atlase norisināsies divās kārtās – rakstiskajā un mutiskajā.
- Pieteikšanās: Aicinām pieteikties pēc iespējas ātrāk, bet ne vēlāk kā līdz 17. augustam.
- Pieteikumus lūdzam sūtīt uz e-pastu: maris.lejnieks@lu.lv.
- Pieteikšanās secībā tiks piešķirtas atlases vajadzībām lomas – pieteicējs vai atbildētājs. Saņemot ziņu, ka jūsu pieteikums atlasei ir reģistrēts, jūs saņemsiet arī norādi uz pārstāvamo pozīciju.
- Rakstiskā daļa: Rakstiskais darbs, aizstāvot izlozēto pozīciju (pieteicējas vai atbildētājas valsts), jāiesūta uz maris.lejnieks@lu.lv līdz šī gada 31. augustam.
- Mutiskā daļa: Atlase noritēs 4. septembra vakara pusē, rēķinoties ar pretendentu un atlases tiesnešu darba laiku.
- Precīzs atlases laiks un vieta tiks noteikts 2. septembra vakarā.
- Mutiskā atlase var izpausties gan kā savstarpēja pretendentu izspēle, gan kā intervija. Visas norises notiks angļu valodā.
Sacensību kāzuss un atlases uzdevums
Šobrīd International Law Students Association nākamā gada sacensību kāzusa problemātiku definējusi īsi:
“The Jessup 2027 Problem presents the following issues: (1) allegations of gender apartheid; (2) State responses to a mass influx of migrants seeking asylum; (3) sanction designations generated by artificial intelligence; and (4) all of this in the wake of a coup d’etat, resulting in a government whose status within the international community remains contested.” (sīkāka informācija: https://www.ilsa.org/jessup/jessup-2027/)
Tā kā paša sacensību kāzusa publiskošana tiek solīta vien 15. septembrī, komandas atlases vajadzībām tiks lietots sekojošs kāzuss:
After World War I, Alpha became a secular republic, but the influence of the dominant local religion on society is still significant. Beta, Alpha's neighbouring country, is a country that has long been torn apart by local internal conflicts, where regional landlords hold de facto power, and where there are ongoing conflicts between them over influence and power in Beta.
In 2021, armed clashes began in Beta between one of the region's inhabitants and the police forces of Beta's central government, which gradually escalated into military clashes between the country's regional landlords and the central government, as well as a large-scale civil war between the regional landlords. The ongoing hostilities, which continue with varying intensity to this day, have created an unprecedented flow of refugees in the region, including to neighbouring countries.
In 2025, a successful military coup suddenly takes place in Alpha. A group of high-ranking officers in the Alpha army suddenly proclaims itself the country's new government. The ousted government manages to flee the country and take refuge in the Republic of Gamma, a democratic Western country. It soon becomes apparent that the new government of Alpha is radically changing the country's political course, transforming Alpha from a secular state into a theocratic state led by the country's dominant religion. This dominant religion in Alpha is described as distinctly patriarchal and hostile towards foreigners and members of other religions. However, the new government has gained full control of the country, and all state institutions are subject to it, including Alpha's diplomatic missions in many countries around the world.
After the start of the civil war in Beta, several hundred thousand refugees from Beta have taken refuge in Alpha, and the previous Beta government placed them in relatively mild refugee camps. However, after the coup d'état in Alpha, the situation of these refugees changes radically. While the situation of male refugees does not change significantly, the situation of female refugees changes radically under the influence of the dominant religion in Alpha. Women are in fact reduced to the status of slaves. The new regime sells them to any interested buyer, but in case of disobedience, they are either subjected to cruel corporal punishment or even often killed.
The policy of the new Alpha government causes outrage and objections from many countries around the world. As a result, most countries in the world, including the Republic of Gamma, refuse to recognise the new Alpha government. Moreover, the Republic of Gamma, like many other like-minded countries, imposes sanctions against Alpha's government and religious officials, as well as against Beta's female enslavers and slaughters. The sanctions take the form of both a ban on the entry of sanctioned persons into Gamma and the freezing of their assets in the territory of Gamma. To make the imposition and application of sanctions more effective, the Gamma government uses artificial intelligence tools to profile Alpha citizens based on publicly available data. International human rights organisations have expressed concern that thousands of Alpha citizens are suffering as a result, as they have virtually no opportunity to challenge the sanctions imposed by Gamma in court.
In 2026, seeing that the sanctions are not having the desired effect, the Gamma government decides to take action against Alpha in the UN International Court of Justice. Given that Alpha has not recognised the jurisdiction of the UN International Court of Justice, the Gamma government bases its claim on a violation of the CERD Convention, to which both Alpha and Gamma are parties, by fulfilling all the prerequisites set out in the Convention for bringing an action before the UN International Court of Justice.
Gamma asks the court to rule that:
- Alpha, by taking action against Beta refugees, is in breach of the CERD Convention;
- Given that the only internationally recognised government of Alpha is the government in exile in Gamma, only it has the right to represent Alpha before the UN International Court of Justice.
The new government of Alpha asks the court to rule that:
Alpha has not violated the CERD Convention, but on the contrary – Gamma's sanctions against the people of Alpha violate the CERD Convention.
The new government of Alpha is the only legitimate government in Alpha. Alpha's immigration policy is exclusively an internal matter for Alpha, or alternatively, it is the only way Alpha can defend the core values of its culture.
